Waqf means ‘in the name of Allah’, that is, land that is not in the name of any person or institution. The Waqf Board has a surveyor. It decides which property is Waqf Board and which is not. There are three grounds for this – if someone has sold his property to the Waqf, if a Muslim or Muslim organization has been using the land for a long time or if the survey proves that the land is Waqf property. The Waqf Board had the task of controlling the lands of the Muslim community. Its purpose was to take advantage of the lands and benefit them illegally.
How does the Waqf Board work
Wherever the Waqf Board fences a graveyard across the country, it declares the land around it as its property. The Waqf Board takes possession of these graves and the lands around it. Since the Waqf Act of 1995 says that if the Waqf Board feels that a piece of land is Waqf property, then the responsibility of proving it is not its responsibility, but that of the real owner of the land to explain how his land is not Waqf. The 1995 law does say that the Waqf Board cannot claim any private property, but how will it be decided that the property is private? If the Waqf Board just feels that a property belongs to Waqf, then it does not have to present any document or proof. All the papers and proofs must be given to the person who has been the claimant till now. Who does not know that many families do not have proper papers of the land. The Waqf Board takes advantage of this because it does not have to provide any paper to take possession.
Why Waqf Board is in news?
New Delhi: The Waqf (Amendment) Bill, 2024 has been referred to the Parliamentary Committee. Union Minority Affairs Minister Kiren Rijiju introduced the bill in the Lok Sabha. During the discussion, opposition MPs strongly opposed the bill. From Congress, SP, NCP, TMC, DMK, Muslim League to AIMIM, members of all opposition parties argued against the bill. Almost all the members described the bill as against the Constitution and secularism. Some members said that if there cannot be any non-Hindu in the management of temples, then discrimination is being emphasized by making a provision to bring non-Muslims in the Waqf Board. However, JDU MP and Panchayati Raj Minister Rajiv Ranjan Singh alias Lallan Singh refuted it in a very logical manner. He said that the Waqf Board is an institution formed by the law of Parliament whereas the temple is not formed by law. The Waqf Board cannot be compared to the temple. If there was any interference in the governing body of mosques, questions would have been raised, but if an institution formed by law becomes autocratic, then it needs reform. After the army and railways, the Waqf Board has the most properties. Waqf has 8 lakh 70 thousand properties. Waqf is the third largest landowner in the country. Waqf has the most properties in UP. There are two types of Waqf boards in India, Sunni and Shia Waqf Board. Sunni Waqf has more than 2.10 lakh properties and Shia Waqf has more than 15 thousand properties. The Waqf Board Act was passed in 1954. In 1995, the Waqf Act was amended, in which the rights of Waqf were increased. The Waqf Board has more than 8.7 lakh properties, which are spread over 9.4 lakh acres. Meanwhile, the All-India Muslim Personal Law Board also made it clear that any kind of interference in the legal status and rights of the Waqf Board will not be tolerated. According to sources, the government is going to introduce a bill in Parliament to amend the 1995 law governing the Wakf Board to ensure greater accountability and transparency in its functioning and mandatory participation of women.

At present there are 32 Waqf Boards in the country which are not Waqf even in Goa, Arunachal Pradesh, Mizoram, Nagaland, Daman and Diu.
The meaning of Waqf Alal Aulaad
Waqf Allal Aulad- The property which is donated by a Muslim. The donated property is used for public welfare, but the management is with the donor’s family, the family members cannot sell such land. They can decide on the use of the property.
